To all the yellow light runners, trust me, it is more common than you think!

From the elite ICBC Lawyers at Steve Kooner Law Corporation, a Surrey based law firm. Find out more at Steve Kooner in Your Corner.

Why do people got into T-boned accidents?

It might not be what you can think of, but there are countless of reasons why people got involved in this type of accident. The most straightforward situation is probably running a yellow light that is turning red. That is, if you are running a yellow light, chances are there are other vehicles are waiting to turn left in that intersection. They might not see you coming, or were also running the yellow light to turn left. Of course, as a consequence of every accident you cause, your insurance rate will shoot over the roof top for at least the next 3 years. Your insurance policy has to pay off for the other party’s claim and it might be not enough, to name a few.

What to do?

If your car is insured, which is mandatory for all motor vehicles in British Columbia, ICBC auto insurance will cover all the cost for you as if you were involved in every other car accidents. That is, if you are injured, all the treatments expenses will be paid off by ICBC. If you are unable to work due to your accident-related illness, ICBC has you covered too. This applies even when the at-fault party flee the scene (a.k.a hit and run accidents).

However, there is a catch in all ICBC claims. You have to contact ICBC immediately to report about the accident. There are statutory time limit to some of your actions as well. Without doing it right, it might be very difficult to claim any compensation from the insurer. So what can you do? Here is some examples of things that you can do:

+ know the law well, especially the statutory time limit.
+ call the police right away after you found that the other drivers does not coperate or admit that they are at fault.
+ find all available camera footages surrounding the scene for evidences.
+ look for witnesses.
+ hire a lawyer to represent you.

You should keep in mind that the sooner you attempt to do these tasks the better for your ICBC claim.

Where to get help?

While you might be able to attempt all the tasks, some people still prefer to hire a lawyer to represent them and direct them in what to do and what not. Most of injury cases incur no legal cost upfront as the lawyers often work in a percentage basis. That is, they only get paid when you settle your injury claim.

At Steve Kooner Law Corporation, a firm of Surrey-based ICBC Lawyers, we offer premium legal advices with no obligation whatsoever.

Accident benefits

accident benefits

From Steve Kooner in Your Corner, a production of Steve Kooner Law Corporation, ICBC Lawyers & Car Accident Lawyers, Surrey.

What are accident benefits?

In Canada, particularly in British Columbia, accident benefits provide relieves to an injured person in a car accident regardless of who is at fault for that car accident. If you have never involved in a car accident, are a cyclist or a pedestrian, chances are you never heard of accident benefits or do not know if an at-fault party is still entitled to receive accident benefits.

Accident benefits cover several items such as treatment cost or loss of income from disability. You might immediately wonder how these items are paid for and under which insurance policy, especially if you do not have insurance on yourself (eg. you are a passenger in a motor vehicle accident) or you are at fault for the accident. Regardless of who is at fault, accident benefits will be paid out from your insurer, which is ICBC in British Columbia. If you are a passenger, the insurer of the car you were sitting in will pay for the compensations.

Your right to the compensations.

Are you eligible for accident benefits? If you fall into one of the following situations:

+ passenger in an insured vehicle in British Columbia
+ member of the house of the vehicle’s owner
+ a pedestrian or cyclist hit by a motor vehicle
+ owner of the vehicle that involved in the car accident

you are eligible for receiving accident benefits.

Beside treatment cost to help you recover from your injuries, accident benefits also cover income-related losses. An example of these is when you are unable to work due to your injuries. Moreover, if you are a homemaker and are not able to perform your daily tasks, accident benefits allow you to hire someone else to do the work for you.

What are the limits?

ICBC recently increases the limit on the compensations from $150,000 to $300,000 so it covers you more than ever before. The list of treatments covered is also expanding, including kinesiology, acupuncture, or counselling to name a few.

However all related costs have to be justified as reasonable and necessary by your ICBC adjuster.

Bad driving records

Bad driving records often make people feel guilty, especially when they are involved in a car accident.

From the time we earned our driving license, it is not always that we are in good shape on the road. Sometimes accidents do happen, which might make your driving record looks bad. These unexpected mistakes often haunt one’s life for very long time. For example, your insurance premium is most likely affected by these incidents.

Other situations when these bad driving records might come back at you is when you get into another accident in the future. It is not uncommon to see someone who involved in a car accident feels guilty themselves if they already have a bad driving record.

It is important to note that, however, bad driving records do not automatically put someone at fault for a car accident. So if you worry that the accident can be blamed on them just because of their bad driving records before that accident, worry not.

In every car accident, what is important and relevant in accessing who is at fault and at how many percentage, is what happened at the time and place of the accident.

In Steve Kooner Law Corp, we always encourage our clients to stand their grounds and should not be worried if they have had a bad driving record. If you feel uncomfortable about this issue, speak to a car accident injury lawyer of your trust.

Steve Kooner Law Corporation has been helping car accident injured clients in many year with lots of situations and cases. With extensive experience, we always try to work as close to your case as possible. You only have one case of yourself, talk to a lawyer that does care.

Unusual Injury Symptoms Could be Dangerous!

Unusual injury symptoms are often overlooked but unfortunately could be very dangerous.

Car accident injury cases usually involve a variety of injury types. For some people, they are simply just soft tissue injury or STI, such as strain muscles. For some other unlucky ones, they might suffer brain or nerve injury, or psychological injury such as depression. Unfortunately not all the symptoms are easily spotted and identified. It is actually very common for people to underestimate their pain. Therefore, they often overlook many more serious types of injury.

An example is that when you feel numbness or shooting pain down your ligaments. This might indicate a much more serious problem than just a simple whiplash type of injury – nerve injury.

The more serious the injury is, the more effort you have to spend at resolving it. It probably involves special types of treatments and in worst case, you might need to go through a surgery. Consequently, this means that the cost it will take to resolve or at least ease out the injury could skyrocket to a very unexpected amount.

So at Steve Kooner Law Corp we always advise that you should be careful if you have any unexpected, unknown symptom. Even if it is just a small uncomfortable pain, always ask your doctor to check it.

Steve Kooner Law Corporation has been helping injured clients in more than a decade with a lot of unusual injury symptoms. With extensive experience, our team of injury lawyers always strive to suggest the best treatment options for your injury.

Child seat in Accident-involved Vehicles

When a child seat (or carseat) is presented in the vehicle that was involved in a car accident, consider to replace it.

The good thing is, if you have proper vehicle insurance, there is a good chance that your child seat will be replaced by your insurance company (ICBC in British Columbia) for free. They will be willing to do that for you for good cause.

This is important because there might be hidden damage to the child seat that you cannot see, such as broken inner base.

So for the safety of your lovely little one, consider to replace your child seat if that child seat happened to be involved in a car accident.

Sharing the road with cyclists

How do we as the motorists share the road safely and enjoyably with our fellow cyclists?

Continuing with our motorists-cyclists road sharing topic series from last week, let’s talk about how should we as the motorists respect our cyclists fellows. If you have not read the first part of this conversation, feel free to have a look here.

As discussed about last week, we the North American dwellers are pretty slow in catching up with the cycling culture. As a result, many of our roads do not have proper, designated bike lanes for cyclists. Consequently our cyclists are faced with road safety issues and sometime inevitably slows down the car traffic in single lane or congested roads. As a motorist, what should we do? Should we be frustrated waiting for the cyclists to speed up, especially when we are a little bit rushing? Should we demand them to stop to the side of the road just to let other vehicles pass through? Etc.

One of the crucial rule for shared road use is to respect one another. What this means is that everybody has the same right to use the road (undesirably true in the cyclist-motorist road sharing situation). So until our city has better funding for more bike lanes, let’s learn to be patient and help our fellow cyclists to have a safe commute by not dangerously pass them or honking at them.

The bottom line here is, when using or sharing the road, the most important thing is not about you or if you will reach your destination on time, it is the safety of everyone. As the “old” saying: when someone (ok I admit, I changed this a little bit!) gets hurt, nobody wins.

Road Rules for Cyclists

What are the road rules for cyclists?

It seems that the more developed we are, the closer you are with the environment. Cycling to work is one of such things. On well developed countries such as many European countries, South Korea or Japan, you will see a lot of bike lanes built specifically for cyclists. Bike lane is a very safe measure to separate cycling traffic from other fuel-powered transportation means. However in places like North America where roads are designed and built mostly for cars, we are living the car era for a very long period of time.

With the fast development of our society, bikes have been receiving a lot of attention from our urban dwellers. Unfortunately, sometime the infrastructure needs a lot of time to be able to catch up with the society so on many roads, cyclists often have to share the road with other engine-operated vehicles without a dedicated bike lane. This is quite a dangerous and sometime tedious situation where the cyclists cannot drive fast and do not have necessary body protection.

In such situations, it is important that all the road users to understand the road rules. This is because, unlike all motorists who already went through a comprehensive licensing procedure with many hours of driver training, cyclists only receive their road safety education unofficially, either via their parents or some private programs.

In this video series, I’ll talk about the responsibility of both cyclists and motorists when sharing the road together. Essentially in this video, the important take away is that if you are riding your bicycle, you should spend sometime understand the use of the road because in BC, you will follow the same road rule as all other motorists. This includes understanding and following the road signages, lane uses and etc. One of the example is that when you are riding your bike in slow moving traffic, do not be tempted to weave in and out among other slowly moving vehicle just to get ahead. You should always pay close attention to your surroundings and follow all the road rules.

With this information in mind, you should now be aware that car accidents do not involve only motor vehicles but it could be cyclists as well.

A lot of the time when someone gets injured in a car accident, the cost of the treatments such as physiotherapy, light therapy might be too high to be affordable. This often discourage the person to seek enough treatment for his injury. However, your vehicle insurance company might be able to advance the fund upfront to cover some of the cost for your accident injuries.

For example, in British Columbia, the insurance company which is ICBC has a program with chiropractors where in that program, 100% of the treatment cost will be covered upfront. So if you found yourself unlucky to be involved in a car accident and injured, do not rule yourself out if you do not have enough money for your treatment. If you are pursuing an ICBC claim, always seek help and advice from a trusted lawyer.

Hit and run accidents

In hit-and-run injury cases, the victims also have to make certain efforts… ~ Injury Lawyer

Hit and run is one of the most frustrated cause for your car accident injury. You have no idea who caused your accident and consequently, have no one to blame or sue. While this might sound like a dead end, fortunately most of the time your vehicle insurance will be able to compensate for your loss, both physically, emotionally and for your vehicle’s damages as well. However, the compensation will not be automatically available and thus, you should not be easy going about it. In order to have a successful claim for your hit and run accident, there are usually certain legal duties you have to take.

In British Columbia, when you get injured in a hit and run accident where you do not know the party at fault, the insurance company – ICBC would still compensate for your losses, provided that you have taken adequate effort to try to identify the driver who hit you and took off. This sounds difficult, but here are a few things you can do.

You can call the police right away, get them to the accident scene and also notify ICBC about the accident right away. Remember to follow up with the police.

If there are witnesses around, try to asks for help and get their contact information. Otherwise, make sure you put up posters at the accident scene looking for witnesses. You can also put up a newspaper ad, or a craiglist ad to look for witnesses.

You can also try to see if there are camera footages around the accident scene. This is not limited to city camera but you can also look for residential security cameras nearby to see if they caught the accidents.

These are just a few example of things you can do. There are other things you have to do to fulfill your legal duties and also there is a time limit for your action.

So it is advised that if you unsure about your obligation, speak to a lawyer.

At Steve Kooner Law Corporation, we always try our best to bring relieves to our injured clients. One of these is free consultation session for injured people who are not at fault in their car accidents. You are always welcome to book an obligation-free, one-to-one consultation with one of our lawyers to find out what level of compensation you can have or what kinds of special treatments that are covered by the insurance policy.
